Police asked to see email correspondence between shadow immigration minister Damian Green and Tory MP David Davis, it has emerged.

Mr Davis told the Commons about the request yesterday, in an effort to ascertain the rules surrounding MPs emails and the police.

The former shadow home secretary told MPs: “My honourable friend [Mr Green] has been approached by the Metropolitan police and asked for access to email between him and myself.

“Does this come under your ruling that it will require a warrant and will be referred to you for your personal decision?”

Speaker Michael Martin said he did not know about the request, but would investigate the mater and report back to MPs.

A police search of Mr Green’s office without a warrant last November led to a constitutional crisis in parliament.

The Speaker has now confirmed any future police searches of an MP’s offices would require his personal authorisation.
