ECJ should not rule on Northern Ireland disputes, says attorney general

The Attorney General Suella Braverman has blasted the European Court of Justice’s (ECJ) oversight role in the Northern Ireland Protocol.

Speaking to Sky News yesterday night, Braverman stressed: “The European Court of Justice should not be the final arbiter of disputes between the UK and the EU and the Bill that we have considered introducing will reflect that”.

The protocol was implemented to prevent a hard border between Northern Ireland and the Republic of Ireland in the wake of Brexit by keeping Northern Ireland in the EU’s single market for goods. It has been heavily criticised by unionist groups for allegedly undermining the union between Northern Ireland and the rest of the UK, which remains outside the EU customs union.

On the topic of publishing the legal advice around the protocol Braverman said: “We are not going to publish the legal advice. It is incredibly rare for the government to publish its legal advice………I think what the government is doing is it will be setting out a bit more detail about the legal basis so that people have a bit more of an understanding about why we think the action taken is lawful.”

Regarding the growing cost of living she argued that “the government has already acted.”

“Whilst we accept times are tough for many households around the country because of inflation, caused largely because of factors outside of our control, I must add, we have seen similar trends in the US and the EU, it is right that the government should act,” she went on.
