18/07/2008: Intellect: Completing the IT contract now - session four: Dealing with IT contract litigation – how to get out alive!
Friday, 18 Jul 2008 10:29
Hosted by Blake Lapthorn Tarlo Lyons (BLTL), this breakfast briefing is designed to share BLTL’s and industry expert speakers’ real life and practical experiences of IT contracts, clauses and negotiations in order to help you complete your contracts quicker and with better results.
What's being talked about?
Today's economic climate is likely to generate more contractual disputes – particularly where organisations are less minded to accept defaults or "write off" losses and are likely to try to recover these losses.
Attendees will benefit from:
stopping litigation early by using the right contractual provisions
useful tips on how to avoid being the subject of legal proceedings
understanding the dispute resolution and litigation process
finding out how organisations have lost their case even before it starts
typical areas for dispute and case studies (e.g. the Fujitsu v EDS case and other cases)
choosing the best procedures and forums for IT dispute resolution
practical measures to take to maximise the chance of success at trial
how to use "offers to settle"
understanding phrases and processes in litigation (e.g. “without prejudice”, the cost implications for you in litigation and the disclosure obligations)
Why should I attend?
Model clauses will be shared with attendees and a full set of notes surrounding the talk will be provided for attendees to take away. There will also be a Q & A session and an opportunity to network with attendees to share ideas and practical solutions to typical dispute issues.
