The upcoming equality bill will make the British National party's (BNP) membership criteria illegal, Harriet Harman has confirmed.

Speaking during business questions opposite Alan Duncan, Ms Harman responded to concerns about the election of two BNP MEPs last week in the European elections.

Ms Harman said she was "shocked and horrified" by their success but went on to say its constitution - which bars non-whites from membership – would become illegal once the equality bill was passed.

"There is no place for a political party in this country to have an apartheid constitution and the equality bill will prevent this from being the case," she said.

Andrew Brons and party leader Nick Griffin were elected as MEPs for the Yorkshire and the Humber and north-west regions with 9.8 per cent and eight per cent respectively in European elections held last week.

Later in the session a Conservative MP suggested to Ms Harman the reason voters in these two "great regions" had turned to the BNP was because of widespread frustration with mainstream parties' ability to deal with the issues of the day.

Ms Harman said that "throughout history" when there had been fear for people's jobs and standards of living "that always provides opportunities for stirring up of apprehension and fear by far-right parties".

She added: "There is no place in British national life and democracy for a party that excludes people on the basis of the colour of their skin".

Ms Harman has a strong record on equality issues and is currently minister for women, beyond her roles as deputy Labour leader and leader of the House.

The equality bill consolidates all the UK's disparate equality laws into one piece of legislation, including laws related to the provision of goods and services, although it is unclear if it will be these sections which affect the party.

A BNP spokesman told politics.co.uk that the move showed "a certain level of desperation" on the part of the government.

"They've never taken this approach to us before. Now we've won they're suddenly talking about changing the voting system and now taking some sort of legal course with our constitution," John Walker said.

"This government have the audacity after their shambolic showing with the poll results that their parties received… to try and change the voting system when they have no mandate from the British people whatsoever."

He suggested the party may put forward some legal arguments to combat the government's proposals and added: "These people would obviously by their actions like to see us shut down."

In June 4th's European elections, won by the Conservatives, Labour came third overall with 15.7 per cent of the overall vote. The BNP were sixth with 6.2 per cent.

  • "Will this 'equality' Bill also apply to the Black Police Officers Association, the Muslim Council of Great Britain, the Black Lawyers Association and the myriad of other self-interest, racially exclusive groups? Just like those organisations mentioned above, the BNP is exempt from the Race Relations Act 1976, as amended by the Race Relations Amendment Act 2000. Its membership constitutes a group of more than 25 members whose main purpose is to provide services to a particular racial group - the Indigenous British. Harman will be thwarted by her own laws."

  • "I don't know why I'm posting a comment, because it will not make any difference, but here's a thought. Politicians rarely engage brain when purporting these hair brain schemes and scams, do they? Does this mean that anybody will be able to join an ethnic association such as the Black Police Association, Lawyers, Architects etc. the list is endless. If they (the politicians) wanted harmony these associations should not have been created in the first place. I don't know if also still applies, but to join the Scots Guards, you have to be Scottish, will that change."

  • "I don't get it. Westminster represents migrants far better than they do the British. Labour have turned their back on the us. Other than the British National Party who are we meant to turn to? Migrants now have many of our jobs. The houses we were encouraged to purchase are being repossessed at an alarming rate. We can't even get on the social housing list because we are classified as non-urgent cases - even though we've been paying our taxes into the treasury for centuries unlike Johny-come-lately. Without a return to democracy, the British National Party is all Brits' have."

  • "I think this is both wrong and short-sighted. First, as a matter of principle I would rather that people have the right to to have clubs and groups that cater for particular groups e.g. all-male or all-female social clubs, black lawyers and yes, however wrong-headed, a political party for whites.Government should not be interfering in people's freedom of association. How many black people would really want to join the BNP? On a practical level is it really a good idea for the main parties to force the BNP to reform its constitution? If the BNP did so, a major plank of criticism would be removed. No legislation can be passed to dictate its policy, so it would still be a racist party, but with a newly respectable constitution."

  • "IMO a case could be made that the BNP is in fact operating illegally. This is a political party seeking political power over all Brits. Political power means the privilege of framing rules and regulations that all Brits must follow. The BNP seeks power to legislate and enforce that legislation by means of police and judiciary system. And yet the BNP bars certain Brits from being members of the BNP for what most of us would term capricious grounds. In short, only 'indigenous whites' may be members of the BNP, and yet the BNP seeks powers over all British citizens, whatever their colour, creed or ethnic origin.   • "I am personally not impressed. The BNP's membership criteria are based on members being British and 'originally from the geographical location of the British Isles'. Hey! I hear you cry, that means you can only be white! i.e. 'racist'. If you go to the website of the Black Police Association, they have an interesting definition of the word 'black'. 'Black', they stress, is not based on skin colour, but means police officers who are British, but originated from the geographical locations of Asia, Middle east, Africa and Afro Caribbean. i.e. not racist? Sounds like the pot calling the kettle black. Can I still say that?"

  • " This act is so self destructive. I have a genuine dissability that prevents me from doing the job I love which is a nurse. This means that in effect I could go back to the NHS and insist on being offered a post with a position that would risk the well being of the patients I would be caring for.Out of a sense of responsibility I will not be going down that avenue.
